Spring Facilities Update 5/14/2020

Swimming Pool
As the State of Missouri relaxes its rules regarding stay-at-home orders and essential businesses, some activities are starting back up that were previously suspended. People are going back to work and tensions are easing just a bit. That’s a welcome change that we all hope continues.

However, the orders have not relaxed completely and we are still nowhere near “normal”. The City recently rolled out our current phase of re-opening, which is expected to last 3-4 weeks. This phase includes stringent rules related to the opening and operation of both public and semi-private pools, which apply to Spencer’s Crest. The rules include rigorous cleaning and disinfecting throughout the day, water testing and limiting the number of people in the pool area to 10 while enforcing social distancing requirements. Furthermore, a safety plan has to be approved by the Health Department to ensure all guidelines will be followed, and requires an individual to take full responsibility for the implementation and enforcement of the plan. Operating within these guidelines is simply not financially feasible at this time.

The Board has taken other factors into consideration, such as the liability to the association, and ultimately to the owners. Insurance policies do not cover bacteria and viruses, putting the association at risk of litigation without coverage.

We do plan to continue monitoring the City/County orders as they apply to the swimming pool, and will be prepared to open at any time should the guidelines relax to a level that is safe and feasible for the association. Please know that should the pool open at any time during the season, we will need the full cooperation of the residents to stay within the social distancing and occupancy guidelines to avoid financial penalties or closure by the City.

Shelter Restroom
For many of the same reasons listed above, the Board has voted to leave the shelter restroom closed so long as the pool is not operating.

Basketball Goals
As you are aware from communication in 2019, one of the basketball goals was removed to discourage trespassing on our common properties. One goal remained until recently for the enjoyment of our residents. Throughout the stay-at-home order, we received numerous reports of groups of individuals playing full-contact games, raising concerns about the spread of COVID-19 and the liability to the association. For that reason, the second goal was temporarily removed to discourage gathering and promote social distancing.
